Sale of Alcohol for Consumption On or Off the Premises

Monday to Sunday from 12:00 to 23:00
On up to six occasions per year the premises will stay open until
00:30. The premises must give notice to the Local Authority
and Warwickshire Police no later than four weeks prior to the event.
The outdoor area will not be used after 23:00

Supply of Alcohol

1. No supply of alcohol may be made under this licence:
A) At a time when there is no designated premises supervisor in
respect of it, or
B) At a time when the designated premise supervisor does not hold a
personal licence or his personal licence is suspended.
2. Every retail sale or supply of alcohol made under this licence
must be made or authorised by a person who holds a personal licence.
3. (1) The responsible person must ensure that staff on relevant
premises do not carry out, arrange or participate in any
irresponsible promotions in relation to the premises.
(2) In this paragraph, an irresponsible promotion means any one or
more of the following activities, or substantially similar
activities, carried on for the purpose of encouraging the sale or
supply of alcohol for consumption on the premises—
(a) games or other activities which require or encourage, or are
designed to require or encourage, individuals to—
(i) drink a quantity of alcohol within a time limit (other than to
drink alcohol sold or supplied on the premises before the cessation
of the period in which the responsible person is authorised to sell
or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit
or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free
or for a fixed or discounted fee to the public or to a group defined
by a particular characteristic in a manner which carries a
significant risk of undermining a licensing objective;
(c) provision of free or discounted alcohol or any other thing as a
prize to encourage or reward the purchase and consumption of alcohol
over a period of 24 hours or less in a manner which carries a
significant risk of undermining a licensing objective;
(d) selling or supplying alcohol in association with promotional
posters or flyers on, or in the vicinity of, the premises which can
reasonably be considered to condone, encourage or glamorise anti-
social behaviour or to refer to the effects of drunkenness in any
favourable manner;
(e) dispensing alcohol directly by one person into the mouth of
another (other than where that other person is unable to drink
without assistance by reason of disability).
4. The responsible person must ensure that free potable water is
provided on request to customers where it is reasonably available.
5. (1) The premises licence holder or club premises certificate
holder must ensure that an age verification policy is adopted in
respect of the premises in relation to the sale or supply of alcohol.
(2) The designated premises supervisor in relation to the premises
licence must ensure that the supply of alcohol at the premises is
carried on in accordance with the age verification policy.
(3) The policy must require individuals who appear to the responsible
person to be under 18 years of age (or such older age as may be
specified in the policy) to produce on request, before being served
alcohol, identification bearing their photograph, date of birth and
either—
(a) a holographic mark, or
(b) an ultraviolet feature.
6. The responsible person must ensure that—
(a)where any of the following alcoholic drinks is sold or supplied
for consumption on the premises (other than alcoholic drinks sold or
supplied having been made up in advance ready for sale or supply in a
securely closed container) it is available to customers in the
following measures—
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii)still wine in a glass: 125 ml;
(b) these measures are displayed in a menu, price list or other
printed material which is available to customers on the premises; and
(c)where a customer does not in relation to a sale of alcohol specify
the quantity of alcohol to be sold, the customer is made aware that
these measures are available.
7. The admission of children under the age of 18 to film exhibitions
permitted under the terms of this licence shall be restricted in
accordance with any recommendations made
A. By the British Board of Film Classification (BBFC) where the film
has been classified by that board, or
B. By the Licensing Authority where no classification certificate has
been granted by the BBFC, or, where the licensing authority has
notified the licence holder that section 20(3) (b) of the Licensing
Act 2003 applies to the film.
The Licensee shall comply with such provisions of the Cinematograph
(Safety) Regulations 1955 as restrict the use of the premises.
8. 1) A relevant person shall ensure that no alcohol is sold or
supplied for consumption on or off the premises for a price which is
less than the permitted price.
2) For the purposes of the condition set out in paragraph 1—
(a)“duty” is to be construed in accordance with the Alcoholic Liquor
Duties Act 1979;
(b)“permitted price” is the price found by applying the formula— .
P=D + (DxV)
where—
(i) P is the permitted price,
(ii) D is the rate of duty chargeable in relation to the alcohol
as if the duty were charged on the date of the sale or supply of the
alcohol, and
(iii) V is the rate of value added tax chargeable in relation to
the alcohol as if the value added tax were charged on the date of the
sale or supply of the alcohol;
(c) “relevant person” means, in relation to premises in respect of
which there is in force a premises licence—
(i) the holder of the premises licence,
(ii) the designated premises supervisor (if any) in respect of such a
licence, or
(iii) the personal licence holder who makes or authorises a supply of
alcohol under such a licence;
(d) “relevant person” means, in relation to premises in respect of
which there is in force a club premises certificate, any member or
officer of the club present on the premises in a capacity which
enables the member or officer to prevent the supply in question; and
(e) “valued added tax” means value added tax charged in accordance
with the Value Added Tax Act 1994.
3) Where the permitted price given by Paragraph (b) of paragraph 2
would (apart from this paragraph) not be a whole number of pennies,
the price given by that sub-paragraph shall be taken to be the price
actually given by that sub-paragraph rounded up to the nearest penny.
4) (1) Sub-paragraph (2) applies where the permitted price given by
Paragraph (b) of paragraph 2 on a day (“the first day”) would be
different from the permitted price on the next day (“the second day”)
as a result of a change to the rate of duty or value added tax.
(2) The permitted price which would apply on the first day applies to
sales or supplies of alcohol which take place before the expiry of
the period of 14 days beginning on the second day.

applicable to the control of plays on this licence are deemed not to
be in operation.

NOTE: Between the hours of 08:00 and 23:00, when Indoor sporting
events are taking place to an audience of less than 1000 people all
licensing conditions applicable to the control of Indoor sporting
events on this licence are deemed not to be in operation.

Live Music

On up to six occasions per year the premises will stay open until
00:30. The premises must give notice to the Local Authority
and Warwickshire Police no later than four weeks prior to the event.
The outdoor area will not be used after 23:00.
NOTE: Between the hours of 08:00 and 23:00, when amplified live music
is taking place to an audience of less than 500 people and the
premises is licensed for the sale of alcohol for consumption on the
premises; or when unamplified live music is taking place to any
number people on any premises, all licensing conditions applicable to
the control of live music on this licence are deemed not to be in
operation.

Recorded Music

On up to six occasions per year the premises will stay open until
00:30. The premises must give notice to the Local Authority
and Warwickshire Police no later than four weeks prior to the event.
The outdoor area will not be used after 23:00.
NOTE: Between the hours of 08:00 and 23:00, when recorded music is
taking place to an audience of less than 500 people and the premises
is licensed for the sale of alcohol for consumption on the premises,
all licensing conditions applicable to the control of recorded music
on this licence are deemed not to be in operation.

Performance of Dance

On up to six occasions per year the premises will stay open until
00:30. The premises must give notice to the Local Authority
and Warwickshire Police no later than four weeks prior to the event.
The outdoor area will not be used after 23:00.
NOTE: Between the hours of 08:00 and 23:00, when performance of dance
is taking place to an audience of less than 500 people all licensing
conditions applicable to the performance of dance on this licence are
deemed not to be in operation.

Prevention of Crime & Disorder

Given the size of the Hall and the nature of events, the number of
people attending any event is unlikely to be more than 40
and (taking advice from fire safety inspectors) we expect a capacity
limit for any event to be around 80.
In many cases, all those attending will be known personally to the
hirer (and often also to the Trustees or members of the
Management Committee).
All bookings will be on the condition that anyone attending who
abuses the nature of the event or attempt to bypass legal
requirements will be refused entry or immediately be escorted off the
premises by the hirer. It will also be a condition of all
bookings that a Trustee (and/or a member of the Management
Committee) can refuse entry to or immediately escorted off
the premises anyone attending who abuses the nature of the event or
attempts to bypass legal requirements.
The building and outdoor area are well lit.
Those attending events are likely to be largely village residents and
so there will be little need for cars to be parked on the
adjacent roads during events.
Six of the Trustees live within 1/2 mile of the premises and a
further Trustee lives within 1 mile of the Premises. All are well
known in the local community. Members of the Management Committee
will also be local people.

Public Safety

We hold full, appropriate Public Liability insurance and comply with
the requirements of the insurers. There will be at least annual Fire
Safety inspection and servicing of fire detection and extinguishing
equipment. (The premises has three distinct exit points and emergency
lighting and signage as required).
There will be an electrical safety check every 2/3 years. (There is
no use or supply of gas at the premises) We will carry out other,
regular health and safety risk assessments, in particular of the
kitchen).
The premises has sufficient lighting internally and externally.
The premises (indoors and out) is a non-smoking area.
There is an entrance hall, which extends from the main entrance doors
to the outdoor area and gives access to the N/S and E/W wings of the
building. There is a paved area in front of the main entrance doors
and this away from the pavement along Wasperton Lane. Collectively,
these mean any 'crush' when people are entering or leaving is
avoided.
Exit from the outdoor area does not require entering the building.

Prevention of Public Nuisance

Any noise nuisance is likely to be minimal as the premises is at
least 25 yards from the nearest house and the building is triple-
glazed. The outdoor area is approximately 15 yards from the nearest
house at the closest point and is enclosed by the building, a
hedgerow and fencing.
However:
• Most events will be indoors, with doors & windows closed.
• Events will end by 11.00pm (with a maximum 30mins for the premises
to be cleared and vacated).
• The Premises Licence application does seek permission to be able to
have events finishing later than 23:00 on a small number of occasions
during the year, e.g. at Christmas or for New Year. We are happy to
accept a restriction that there would be no more than 6 such events
in any year that any such event would finish no later than 00:30 and
that the outdoor area would not be used after 23:00.
• Hirers will be made aware that the premises are in a residential
area and required to be mindful of this, asking all attendees to
arrive and leave with minimal noise after 9pm.
• For any events that will be using the outdoor area after 9pm or any
event using the building after 11pm the Trustees/ Management
Committee will seek to provide notice to local residents.
As the premises is a local community hall and the great majority of
use will be by local people, we do not expect there will be a
significant number of cars parked on the roads near the premises
during events.
Many events will involve children who are likely to be dropped-
off/collected by an adult in a car. The Trustees/Management Committee
will require hirers to emphasise to adults the need to park only
where allowed and to ensure local residents are not inconvenienced.

Protection of Children

Children are only allowed to attend events in the premises under the
direct supervision and responsibility of adults and with an
appropriate ration of children to adults (max 5:1 unless other
provisions, e.g. Scout Assn., apply)
Hirers and those attending will typically be individuals known to
Trustees/Management Committee. If a hirer is not known personally by
a Trustee/Management Committee member, a Trustee/Management Committee
member will speak to the hirer before the event to establish if
children will be attending and measures the hirer will have in place
to ensure the safety of those children.
(Before the premises were built, the Charity provided a similar, if
smaller, venue which was used by many local community groups that
included children and the Trustees are not aware of any incident that
gave cause for concern about the safety of a child attending an
event. The majority of users of the new premises will be the same
groups which used the previous building).
For all events involving the provision of alcohol we will:
- promote and abide by the Challenge 25 strategy that encourages
anyone who is over 18 but looks under 25 to carry acceptable ID if
they wish to buy alcohol.
- require hirers to actively check proof of identity of attendees
wishing to buy alcohol who do appear to be aged 25 or under and keep
a register of refusals to serve alcohol to attendees who fail the
Challenge 25 question and cannot produce valid proofs of identity -
encourage hirers to use the register (template available at:

no-sale-a4-refusals-register-2022.pdf) which we will place in the
rear of the Bar area.
- review and discuss the register of refusals at the next
Trustees'/Management Committee meeting
- ensure through training that Trustees/Management Committee members
maintain up-to-date understanding of legal requirements and best
practice relating to provision of alcohol, especially age-related
restrictions (e.g. from the Retail of Alcohol Standards Group
https://rasg.org.uk/about-rasg/ ), Challenge 25
https://rasg.org.uk/materials2/) and No Id No Sale
(https://noidnosale.com/). - make relevant material available to
hirers

General

All requests for hiring the premises will be received by the
Treasurer (it is the Trustees' intention to appoint a Booking Manager
once use of the new Centre has become established) and the
Treasurer/Booking Manager will consider whether the booking can be
accepted, after discussion with the Trustees if any concern.
All bookings for use of the premises must be consistent with the
Objectives of the charity's Constitution, as registered with the
Charities Commission.
For any booking involving the provision of alcohol, access to the
premises will only be with the attendance of a key-holding Trustee at
the start of the hire period (no key issued to hirer) and the Trustee
will confirm the hirer understands the hire conditions and has
arrangements in place to comply.
At the end of the hire period, a Trustee will again attend to ensure
the hirer has left the premises in a good state and to secure the
building. In many cases, a Trustee will be present throughout the
period of any hire involving provision of alcohol or will attend the
premises during the hire to check that the hire conditions are being
complied with.
"Provision of alcohol" includes sale during the event, inclusion of
alcohol as part of any entry charge, use of paid for 'vouchers' to
exchange for alcohol or similar and where alcohol is offered free of
any charge.
Contact details for the key-holding Trustees will be prominent
displayed at the premises so that any concerns can swiftly be raised
by anyone at the event or otherwise.
• A condition of hire for any event involving the provision of
alcohol will be that the hirer must provide, before the start of the
event, the name and contact details of a specific individual who will
be present throughout the period of hire and who will be designated
as the main responsible adult for the booking and required to keep a
record of any unusual activities, such as any attempted purchase of
alcohol for or by under 18-year-olds.
• As the premises is a local community building, it is likely that
attendees at each event where there will be provision of alcohol will
be almost exclusively village residents and therefore well known to
the Trustees (or the members of the Management Committee).
• Event management will be a regular item on the agenda for Trustees'
Meeting (or for the Management Committee which the Trustees intend to
set up). This will include ensuring legal responsibilities and the
conditions of the Premises Licence are fully understood (including
the avoidance of the possibility of alcohol being provided to or for
under-age people).

Conditions agreed with the Licensee

1. The requirement to display permanent Challenge 25 posters in the
bar/kitchen/serving area for alcohol, as a reminder to hirers either
selling or serving alcohol and also to purchasers.
2. On no more than six occasions per year when the venue is permitted
to operate until 00:30, and organisers must notify the Local
Authority and Warwickshire Police no later than four weeks prior to
the event and local residents a minimum of two weeks before the date
of the event.
3. Use of the outdoor area is prohibited after 23:00.
4. All external doors and windows shall be kept closed when regulated
entertainment is being provided, except for access and egress and in
the event of an emergency.
5. Prominent, clear, and legible notices must be displayed at all
exits requesting that customers respect the needs of local residents
and to leave the premises and area quietly.
