Supply of Alcohol

1)No supply of alcohol may be made under this licence:
A) At a time when there is no designated premises supervisor in
respect of it, or
B) At a time when the designated premise supervisor does not hold a
personal licence or his personal licence is suspended.
2)Every supply of alcohol under the premises licence must be made or
authorised by a person who holds a personal licence.
3. (1) The responsible person must ensure that staff on relevant
premises do not carry out, arrange or participate in any
irresponsible promotions in relation to the premises.
(2) In this paragraph, an irresponsible promotion means any one or
more of the following activities, or substantially similar
activities, carried on for the purpose of encouraging the sale or
supply of alcohol for consumption on the premises—
(a) games or other activities which require or encourage, or are
designed to require or encourage, individuals to—
(i) drink a quantity of alcohol within a time limit (other than to
drink alcohol sold or supplied on the premises before the cessation
of the period in which the responsible person is authorised to sell
or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit
or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free
or for a fixed or discounted fee to the public or to a group defined
by a particular characteristic in a manner which carries a
significant risk of undermining a licensing objective;
(c) provision of free or discounted alcohol or any other thing as a
prize to encourage or reward the purchase and consumption of alcohol
over a period of 24 hours or less in a manner which carries a
significant risk of undermining a licensing objective;
(d) selling or supplying alcohol in association with promotional
posters or flyers on, or in the vicinity of, the premises which can
reasonably be considered to condone, encourage or glamorise anti-
social behaviour or to refer to the effects of drunkenness in any
favourable manner;
(e) dispensing alcohol directly by one person into the mouth of
another (other than where that other person is unable to drink
without assistance by reason of disability).
4. The responsible person must ensure that free potable water is
provided on request to customers where it is reasonably available.
5. (1) The premises licence holder or club premises certificate
holder must ensure that an age verification policy is adopted in
respect of the premises in relation to the sale or supply of alcohol.
(2) The designated premises supervisor in relation to the premises
licence must ensure that the supply of alcohol at the premises is
carried on in accordance with the age verification policy.
(3) The policy must require individuals who appear to the responsible
person to be under 18 years of age (or such older age as may be
specified in the policy) to produce on request, before being served
alcohol, identification bearing their photograph, date of birth and
either—
(a) a holographic mark, or
(b) an ultraviolet feature.
6. The responsible person must ensure that—
(a)where any of the following alcoholic drinks is sold or supplied
for consumption on the premises (other than alcoholic drinks sold or
supplied having been made up in advance ready for sale or supply in a
securely closed container) it is available to customers in the
following measures—
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii)still wine in a glass: 125 ml;
(b) these measures are displayed in a menu, price list or other
printed material which is available to customers on the premises; and
(c)where a customer does not in relation to a sale of alcohol specify
the quantity of alcohol to be sold, the customer is made aware that
these measures are available.
7. The admission of children under the age of 18 to film exhibitions
permitted under the terms of this licence shall be restricted in
accordance with any recommendations made
A. By the British Board of Film Classification (BBFC) where the film
has been classified by that board, or
B. By the Licensing Authority where no classification certificate has
been granted by the BBFC, or, where the licensing authority has
notified the licence holder that section 20(3) (b) of the Licensing
Act 2003 applies to the film.
The Licensee shall comply with such provisions of the Cinematograph
(Safety) Regulations 1955 as restrict the use of the premises.
8. 1) A relevant person shall ensure that no alcohol is sold or
supplied for consumption on or off the premises for a price which is
less than the permitted price.
2) For the purposes of the condition set out in paragraph 1—
(a)“duty” is to be construed in accordance with the Alcoholic Liquor
Duties Act 1979;
(b)“permitted price” is the price found by applying the formula— .
P=D + (DxV)
where—
(i) P is the permitted price,
(ii) D is the rate of duty chargeable in relation to the alcohol
as if the duty were charged on the date of the sale or supply of the
alcohol, and
(iii) V is the rate of value added tax chargeable in relation to
the alcohol as if the value added tax were charged on the date of the
sale or supply of the alcohol;
(c) “relevant person” means, in relation to premises in respect of
which there is in force a premises licence—
(i) the holder of the premises licence,
(ii) the designated premises supervisor (if any) in respect of such a
licence, or
(iii) the personal licence holder who makes or authorises a supply of
alcohol under such a licence;
(d) “relevant person” means, in relation to premises in respect of
which there is in force a club premises certificate, any member or
officer of the club present on the premises in a capacity which
enables the member or officer to prevent the supply in question; and
(e) “valued added tax” means value added tax charged in accordance
with the Value Added Tax Act 1994.
3) Where the permitted price given by Paragraph (b) of paragraph 2
would (apart from this paragraph) not be a whole number of pennies,
the price given by that sub-paragraph shall be taken to be the price
actually given by that sub-paragraph rounded up to the nearest penny.
4) (1) Sub-paragraph (2) applies where the permitted price given by
Paragraph (b) of paragraph 2 on a day (“the first day”) would be
different from the permitted price on the next day (“the second day”)
as a result of a change to the rate of duty or value added tax.
(2) The permitted price which would apply on the first day applies to
sales or supplies of alcohol which take place before the expiry of
the period of 14 days beginning on the second day.

General

Use of the licence will be for one weekend (Friday and Saturday)
between the beginning of May through to the end of Sept each year.
For area known (referred to by local authority as Events Space 1).
As soon as agreement has been made with the local park’s authority
for the date of the event, ALL responsible authorities as
defined within the Licensing Act 2003 will be notified of the event
dates and timings. Notification will also include a brief
synopsis of the planned event.
The Premises licence holder will then organise a Safety Advisory
Group meeting, either through the local authority, or if the
authority does not have such capability, organise the meeting
themselves.

Prevention of Crime & Disorder

The event will be subject to the completion of an Event Safety
management Plan (ESMP) (or any other terminology used by
the responsible authorities).
The ESMP will contain as a MINIMUM, security plans, layout, location
of infrastructure, fire exits, barrier plans, vulnerability plans,
drug policy, search policy, age verification, lost child, counter
terrorism measures, last mile, ingress, egress, emergency service
access, entertainment schedule, noise management plans, alcohol
policy, fire safety, waste management, toilets, special effects, bar
management, management structure, medical.
V1 of the ESMP will be submitted 10 working days before the first SAG
meeting.
The frequency of future SAG meetings and ESMP will be determined
through the SAG process.
10 working days before the event the latest version of the ESMP will
be submitted to all the responsible authorities (and interested
parties identified in the SAG process).
Any changes to the ESMP (where a reduction to the level shown in the
previous ESMP), will be submitted to the SAG chair and any
responsible authority deemed necessary.
An emergency SAG can be called if necessary.
The agreed ESMP (including appendices) will become the operating
schedule for the event detailed in the ESMP. The ESMP will become the
operating conditions for that event.

Public Safety

As above.

Prevention of Public Nuisance

The licence shall be restricted to one event per calendar year
comprising of two consecutive days on a Friday and Saturday.
The Premises Licence Holder (or their nominated person) shall notify
local residents in writing with the details of the event and a
contact telephone number, a minimum of three weeks before the
event.
A dedicated telephone number shall be in place for local residents to
contact the event organisers, enabling the event staff to respond to
noise disturbance concerns and react accordingly.
The Premises Licence Holder shall appoint a suitably qualified
acoustic consultant to assist them in fulfilling the requirements of
the premises licence, and to liaise with the Local Authority, sound
system supplier(s) and sound engineer(s) prior to, during and after
the event.
At least three calendar months in advance of the event taking place,
the Premises Licence Holder (or their nominated person) shall submit
a “Noise Management Plan” to the Environmental Health department at
Warwick District Council for comment. Thereafter, the “Noise
Management Plan” shall be implemented and complied with in full for
the duration of the event.
The Premises Licence Holder (or their nominated person) shall ensure
that between 14:00 and 22:00 hours, the Music Noise Level (MNL) of
the event shall not exceed 65dB(A) over a 15-minute period when
measured at the locations specified in the Noise Management Plan.
The Music Noise Level shall not exceed 75dB in the 63Hz and 125Hz
octave bands at the locations specified in the Noise Management Plan.
As part of the Noise Management Plan, the monitoring equipment,
methodology and locations shall be agreed with the Local Authority no
later than one month before the event.
At least three calendar months in advance of the event taking place,
the Premises Licence Holder (or their nominated person) shall submit
a report to the Environmental Health department at Warwick District
Council demonstrating, by theoretical prediction, compliance with the
Music Noise Limits specified in the premises licence.
On the day preceding the event, sound propagation tests will be
undertaken, during which the sound system(s) will be configured and
operated in a similar manner as intended for the event. The sound
source used for the test shall be similar in character to the music
likely to be produced during the event.
Appropriate control limits at the sound mixer position and
adjustments to sound amplification will be agreed as a result of the
testing to the satisfaction of the appropriate responsible authority.
The Premises Licence Holder (or their nominated person) shall ensure
that the music noise levels are continuously monitored at the mixer
position and that off-site music noise levels are monitored at
appropriate intervals throughout the event in accordance with the
Noise Management Plan.
The noise monitoring results obtained during the event shall be
documented to demonstrate compliance with the music noise limits
prescribed in the premises licence.
The noise monitoring results shall be made available to the
Environmental Health department at Warwick District Council on
request and shall also be submitted in writing no later than 28
days after the end of the event as part of a Noise Compliance Report.
The Premises Licence Holder (and their nominated individuals) will
comply with all reasonable requests by Local Authority
representatives to reduce the music noise level to achieve or
maintain compliance with the requirements of the premises licence.
Tasks which may cause a nuisance to local residents during the set-up
and dismantling phase of the event shall not take place before 08:00
nor after 20:00 on any day. If, in exceptional circumstances, works
must be carried out outside of these hours they must only be
activities that can be carried out in a quiet manner without
disrupting local residents. In all circumstances all tasks involved
in the set-up and dismantling phase of the event shall not take place
before 07:00 nor after 22:00 on any day.

1. A 'Challenge 25' age verification policy requiring proof of age by
passport, photo driving licence or PASS accredited card.
2. Keep a 'challenge log' (refusals book) recording all challenges -
where both sales and refusals result (example downloadable refusals

3. A prompt or reminder to staff, at the point of sale, to consider
whether a sale or challenge ought to be made (for example an EPOS -
Electronic Point of Sale - system till prompt or if not then written
notices/stickers at the till point showing age limits) (examples of

)
4. Regular staff training on the Licensing Act 2003 and age
restricted sales, to ensure that both the law and company policies /
procedures are understood, up-to-date and applied consistently.
5. The Premises Licence Holder (or their nominated person) shall
ensure that the Music Noise Level (MNL) of the event shall not exceed
65dB(A) over a 15-minute period when measured at the locations
specified in the Noise Management Plan.’
6. SIA door staff to be employed at a ratio of 1-100 or part there-
of. (a different ratio may be used if agreed in writing with
Warwickshire Police, and through the Sag process)
7. Any queue entering the site shall be kept orderly and supervised
by licensed door supervisors to ensure that there is no public
nuisance or obstruction.
8. The premises licence holder shall ensure that the provision of
door supervisors at the
site is appropriate to ensure the safe control of the event.
9. A search policy will be utilised at the entry point/within the
site, to carry out sweeps of the site and personnel entering the
event.
10. All staff engaged for security or marshalling on site shall wear
high-visibility
vests/tabards
11. Clearly visible notices shall be placed at the entrance to the
site advising those attending that it is a condition of entry that
customers agree to being searched and that the police will be
informed if anyone is found in possession of controlled substances or
weapons.
12. Any persons entering the site may be searched by an SIA-trained
member of staff subject to minimum search requirements and any agreed
search policy at SAG.
13. An incident log shall be kept at the premises and made available
on request to the police or an authorised officer of the licensing
authority and held in the control centre.
14. The Designated Premises Supervisor shall ensure that a written
notice of authority is kept at the control centre for all staff who
sell alcohol. The notice shall be made available for inspection upon
request of the police or an authorised officer of the licensing
authority and all staff selling alcohol must be in possession of
formal identification to verify their identity against the notice.
15. No drinks shall be served in glass containers at any time.
16. All staff will be trained in the Licensing Act 2003; and that
training records will be
retained on site. In addition to training on Challenge 25 and not
serving to intoxicated
customers, staff are also given training all staff working within the
bars will be given training
on procedures on what to do in the case of disorder or an emergency.
Records detailing the
training provided will be retained on site and made available for
inspection.

17. The event organiser/licence holder will employ the services of
recognised and qualified security and stewarding/marshalling company.
Only individuals licenced by the Security Industry Authority will be
used to guard against unauthorised access, outbreaks of disorder or
damage.
18. All security staff/stewards will be easily identifiable and have
the appropriate training for their duties. A register of all SIA and
security staff will be maintained. This will contain their full
names, date of birth, home addresses, employers and where applicable,
their SIA registration details. These details will be made available
to Police and the Licensing team on site.
19. An incident report log will contain date, time, location, and
details of any incident at the
site. The incident logs will be kept at event control during the
event and will be available for
inspection immediately on request by an authorised officer of Police
and the Licensing
Authority.
20. The organiser/premises licence holder will inform Police at the
end of the admission phase of searches resulting in the seizure of
drugs. If a seizure is considered to be of supply level, police to be
notified immediately, along with seizures of offensive weapons. A
suitable purpose made receptacle for the safe retention of illegal
substances will be provided by the event organisers and arrangements
made for the safe disposal of its contents as agreed with the Police.
Any such seizures are to be entered into a drug seizure log which is
to remain in close proximity to the drug box. This log will record
the following details. Time/date and location of seizure, member of
staff seizing, name or description of the person the item was seized
from.
21. Each bar on site will be managed by a Personal licence holder who
is responsible to the DPS.
22. An amnesty box to be located in a prominent place at the point of
entry to the site and prior to search bays with clear prominent
signage visible informing patrons that anyone found in possession of
illegal drugs/weapons will be refused entry and Police may be called.
23. Passive drug dogs to be employed and used at the entry point to
better target persons to be searched (unless the requirement is not
deemed necessary by Warwickshire Police and detailed in writing
through the SAG process).
24. Trained medical staff, proficient in spotting the signs of drugs
intoxicated to be deployed at the point of admission.
25. A minimum of 25% of patrons to be searched.
26. An Event Safety Management Document (specific to the event) shall
be completed
outlining the proposed management structure, responsibilities and
contact details for each
event, together with details of the organisation, control monitoring
and review mechanisms
as identified by the event specific risk assessment and made
available to the Licensing
Authority, Police and Emergency Planning Authority a minimum of 3
months prior to any
event.
27. Clear and prominently displayed notices at exit points requesting
customers to respect local residents and leave the area quickly and
quietly.
28. Full fire cover is on site and all firefighting equipment will be
inspected and serviced
in line with the appropriate British Standard, prior to the event.
29. The premises licence holder shall always ensure that when the
public are present
there is sufficient and competent personnel able to administer first
aid, and that an
adequate and appropriate supply of first aid equipment and materials
is available on
site, and that adequate records are maintained in relation to the
supply of any first aid
treatment.
30. Full medical cover is on site and will be utilizing a pre-
determined location within
the site.
31. Public Address (PA) system on site will be used in the event of
emergencies and evacuation.
32. All event staff, SIA staff, Marshalls/Stewards will be given a
health and safety induction and training on their first day on site,
records of the induction and training are kept on the site during the
event, for production, on request, to an officer of a Responsible
Authority.
33. Appropriate and proportionate arrangements will be made for
fencing, barriers, gate systems, and security to prevent unauthorised
access to the site.
34. The physical layout of the site will be planned with crowd
management and flow in mind. The security team will be briefed to
prevent overcrowding on the site. All entrances and exits will be
always kept clear and checked regularly for obstructions and hazards.
35. A dedicated emergency/blue route will be indicated in the plans
and on site and will be always kept clear for access by emergency
vehicles.
36. The premises licence holder or DPS will carry out pre-opening
checks of the site, to ensure that there are no risks to patrons and
that all safety precautions are in place.
37. Appropriate waste collection bins will be placed on site, and any
excess rubbish will
be bagged and removed at the end of the event. In addition to waste
clearance carried
out by the appointed contractor.
38. The event organiser/licensing agent and premises licence holder
will attend meetings of the Safety Advisory Group (SAG) and take on
board recommendations of the Responsible Authorities. In addition,
they will attend all multi-agency debriefs for the event, if it is
deemed necessary by the Chair of the SAG.
39. All social media will display age applicable entry requirements.
